Acceptance of Terms
By accessing or using Clear Path, the user agrees to use the application only for its intended preliminary screening and decision-support purpose and to review these terms, the disclaimer, the privacy policy, the known limitations, and the definitions and assumptions before relying on any output.
Purpose of Application
Clear Path provides preliminary obstruction-screening and protected-surface evaluation support for planning, internal screening, engineering context, and decision support. It is not presented as an official FAA, DoD, airport sponsor, engineering, surveying, or legal determination system.
Source Criteria and Non-Endorsement
References to FAA, DoD, UFC, Part 77, airport criteria, military criteria, or source documents identify the criteria basis used by the software. Those references do not imply endorsement, sponsorship, authorization, approval, official status, or agency backing from any government entity, command, military unit, airport authority, or other reviewing body.
No Official Determination or Professional Services
Use of Clear Path does not create FAA approval, DoD approval, airport sponsor approval, engineering certification, surveying certification, legal advice, or any other official determination. The application does not replace professional services, formal review, filings, waivers, or other required processes before action is taken.
User Responsibility and Required Verification
Users remain responsible for input accuracy, source applicability, engineering judgment, surveying support where needed, airport coordination, operational review, and compliance review with the authority having jurisdiction. Users must independently verify all inputs, assumptions, criteria, outputs, limitations, and generated reports before relying on the application for design, construction, acquisition, operational, permitting, or compliance decisions.
Known Limitations
Clear Path includes documented limitations, partial criteria coverage, and unsupported pathways. Surfaces or criteria that are unsupported, dependency-gated, or not fully encoded must not be treated as official clearance, compliance, or non-hazard findings.
Generated Reports and Exports
Generated reports, JSON exports, and on-screen results are preliminary work product for review and coordination. They are designed to support planning, design review, internal quality control, and operational decision-making workflows. They do not guarantee compliance, approval, acceptance, or suitability for any specific project purpose without independent verification.
Billing and Email Posture
Public pricing information may be displayed with the access path identified for each plan. Demo registration is self-service from the Home or Plans page, supported recurring plans use the hosted billing path identified in the application, and single-use or manual purchase paths continue through contact and billing review. Public support, privacy, and legal contact is handled through support@airspaceevaluator.com.
Demo registration is generally no-charge unless separately agreed in writing. Single-use access is intended for one evaluation, one report, and one approved use case, and is generally non-refundable once access, evaluation, or report delivery has occurred, except for duplicate charge, billing error, required law, or written agreement.
Monthly plans may be canceled before renewal; access continues through the paid term; no prorated refunds are generally provided except for billing error, required law, or written agreement. Annual plans may cancel renewal; refunds are provided only by written agreement, billing error, or required law. Enterprise, agency, installation, or other manual-billing arrangements follow the applicable written order, quote, or contract.
Prohibited Misuse
Users must not present Clear Path outputs as certified, survey-grade, engineer-sealed, authority-approved, or legally dispositive. Users must not rely on the application to bypass required FAA, DoD, airport sponsor, professional engineering, surveying, or legal review.
No Warranty and Limitation of Liability
Clear Path is provided on an as-is and as-available basis without any warranty of completeness, accuracy, fitness for a particular purpose, noninfringement, regulatory sufficiency, or uninterrupted availability. To the maximum extent permitted by applicable law, the owner and operators of Clear Path disclaim liability for losses, claims, project delays, construction costs, operational impacts, compliance failures, or other damages arising from use of or reliance on the application or its outputs.
Changes to the Application
Clear Path may be updated, revised, restricted, or discontinued. Criteria coverage, output format, and supported workflows may change over time as source logic and review posture evolve.
Governing Law and Dispute Terms
These terms are governed by the laws of Alabama. Any additional venue, dispute-resolution, or organization-specific commercial terms may be supplemented by separate written agreements where applicable.
